Sexuality

The following agencies or groups offer information relating to birth control, family planning, pregnancy counseling, adoption, parenting classes and gay counseling. In order to make informed, responsible decisions, many factors must be considered. The conclusions you reach can have long-lasting effects, so be sure to get as much information as possible about the topics or areas in question.

Abortion Waiver of Parental Consent

In Nebraska and Iowa, a woman must be 18 years old to obtain an abortion without having to get the consent of her parent (or her grandparent in Iowa). If she is under 18 years of age, and she wants to have an abortion, one of her parents must sign a consent to the procedure, and the consent must be notarized. Many times, and for many reasons, the young woman under the age of 18 years wants to have an abortion, but she cannot talk to her parents about this, or she may not even have a parent available to consent to the procedure. The law provides a way for a woman to have a Judge sign an Order allowing her to get an abortion. This is called a Judicial Bypass, or Waiver of Parental Consent. Each County's District Court must provide the information that shows the teenager how to obtain a Judicial Bypass. However, the law is very specific as to what information must be presented to the Judge to show that the teenager is mature enough to make her own decision without the consent of her parent. It is best to have the assistance of an attorney to help with the Bypass. Attorneys who are knowledgeable of this procedure are provided, free of charge, to the teenage woman. The best way to learn about the procedure, and to get assistance from an attorney if you cannot discuss this with your parent, is to visit Planned Parenthood of the Heartland in Omaha or Council Bluffs.

Nebraska: Your state requires that one of your parents be told of your decision 48 hours before your abortion. A judge can excuse you from this requirement.

Iowa: Your state requires that one of your parents or a grandparent be told of your decision 48 hours before your abortion. A judge can excuse you from this requirement.
